Terms

These Terms and Conditions are subject to change without prior written notice at any time, at Club Deck's (CD's) sole discretion. Purchasers of CD products agree to be bound by and accept these Terms and Conditions as the sole agreement applicable to your purchase of product(s) from CD.

1. Pricing and Returns: All sales are final. Prices for each product are as listed on the order confirmation emailed by Club Deck. Club Deck reserves the right to change pricing at any time. Club Deck will replace any product damaged in shipment or containing a printing defect upon return of the damaged or defective product.
2. Payment: can be made via credit card, direct deposit, or via chequeor money orderpayable to Club Deck Pty Ltd. If credit terms have been agreed to by Club Deck, payment must be received within the terms stated on Club Deck's invoice. Late payments will incur interest at 10% per annum.
3. Not For Resale: Purchaser agrees and represents that it is buying for its own use only. Purchaser agrees not to reproduce, duplicate, copy, sell or resell any Club Deck product purchased by the Purchaser.
4. Copyright: Club Deck owns the copyright in products (including information, text, design and layout) purchased by the Purchaser. This copyright is protected by Australian copyright law and international treaties. The Purchaser may not, without prior written permission from Club Deck, reproduce the product, in whole or in part in any form.
5. Consent: Purchaser acknowledges that Club Deck owns the copyright in the products. Purchaser consents to Club Deck selling the products ordered by the Purchaser to third parties, where appropriate. In accordance with the foregoing, Purchaser accordingly waives any rights it may have to personal information (including photographs) supplied by the Purchaser and contained in the product and which may otherwise be protected by relevant privacy laws.
6. Acceptance; Authority: By confirming the Order online, Purchaser agrees that Purchaser has read, understands and agrees to abide by these Terms and Conditions, and Purchaser represents and warrants that Purchaser has full power and authority to enter into this legally binding contract.
7. Warranty: All products and deliverables provided by Club Deck to purchaser are provided "as is" without warranty of any kind. Club Deck further disclaims all express and implied warranties, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. All player details included on Club Deck products are in accordance with what has been supplied by the player, parent, guardian, club or organisation, and Club Deck provides no warranty regarding the accuracy of the player details. Club Deck will reasonably assess money back guarantee claims on a case by case basis.
8. Liability: In no event will Club Deck be liable to the purchaser or to any third party for any special, incidental, indirect or consequential damages of any kind in connection with this order, whether based on breach of contract or otherwise, even if informed in advance of the possibility of such damages. Club Deck's total liability to purchaser under this agreement will be limited to the payments received from purchaser under this agreement.
9. Definitions: "You" and/or "Purchaser" means the entity or person that accepts these Terms and Conditions, as identified herein. "Club Deck" and "CD" means Club Deck Pty. Ltd.
